Below are the standard terms and conditions that are issued along with our contracts when a booking agreement has been reached.
Terms and Conditions
Agreement
1. This Contract represents written confirmation of a prior verbal agreement and no signatures are required to bring it into force.
2. Whilst every reasonable safeguard is assured, the agent is not responsible for non-fulfilment of the Contract by either party.
3. The Artiste's engagement under this contract is such that he/she would normally be treated as self-employed for National Insurance and Income Tax Purposes by reason of being engaged under a contract for services.
Deposit
On receipt of the contract a deposit of 15% of the total fee is required by the Agent from the Hirer within seven working days. This enables the Agent to secure the Artiste for the Hirer's event.
Cancellation
1. Should the Contract need to be cancelled by the Hirer, the following conditions apply:
a) written notification must be received by the Agent at least 56 days prior to the performance and
15% of the fee paid, or
b) written notification must be received by the Agent at least 28 days prior to the performance and
50% of the fee paid, or
c) written notification must be received by the Agent less than 28 days prior to the performance and
100% of the fee paid
2. Provided the Hirer pays the Artiste his/her full contractual fee subject to the Artiste duly rendering services or being ready, willing and able to do so, the Hirer may, without giving any reason, prohibit the whole or part of the Artiste's performance.
3. In the event of the Artiste's illness the following provisions shall prevail. The word "illness" shall mean and include any bodily or mental infirmity.
a) If the Artiste is unable to perform through illness, the Artiste shall notify the Agent immediately
and shall send a medical certificate to the Agent within 7 days setting forth the nature of the illness
b) The Artiste shall, if required by the Hirer, submit to examination by a fully qualified medical
practitioner nominated by the Hirer, with the costs of such an examination being borne by the Hirer.
4. If the Artiste fails to perform at the engagement except through illness or accident beyond the Artiste's control
the Hirer shall not be obliged to pay the Artiste's salary in respect of the Engagement and the Agent shall return
the deposit to the Hirer. The Agent shall make his best endeavors to assist the Hirer to find a replacement Artiste
if so requested.
Health and Safety
1. The Hirer / Artiste is responsible for any claims made against them, and must ensure their equipment is
safe, PAT tested, insured and the Hirer / Artiste carries Public Liability Insurance.
Hirer Responsibilities
1. The Hirer is to provide a suitable performing area. Unless otherwise agreed, the Hirer must provide an electrical supply meeting or exceeding British Standards within five metres of the performance area, where electrical equipment is to be used as part of a performance.
2. Where the Artiste is expected to wear stage clothing or costumes, the Hirer must provide suitable dressing room facilities.
3. The Hirer is responsible for providing adequate supervision and / or security at all times. In the event of unruly or threatening behaviour from any individual, the Artiste is entitled to cease the performance and still be paid in full.
4. The Hirer is not responsible for paying the Artiste for days upon which the Artiste is unable to perform for any reason beyond the Hirer's control such as National Mourning, War, Fire, Strikes or Lock-outs directly affecting the venue, or the Order of the Licensing or any Public Authority having jurisdiction. In any such event notice must be given to the Artiste forthwith, failing which reasonable expenses must be paid.
5. The Hirer agrees not to approach the Artiste directly to engage for further bookings. All future bookings are to be made via the Agent for a period of 12 months from the date of engagement.
6. The Hirer is not responsible for loss of, nor damage to, the Artiste's property unless such loss or damage is caused by the Hirer or his / her servants or agents and / or the property is in the possession or control of the Hirer at the time of loss or damage.
Artiste Responsibilities
1. The Artiste is solely responsible for their own performance on the said event, and for their punctuality and attendance.
2. The Artiste warrants that, at the time of signing this contract, he / she is not under contract to any third party that might preclude him / her from fulfilling the engagement and that he / she will not subsequently enter into
such contract.
